Terms and Conditions

Welcome to Vivanta Stays. Please read these Terms and Conditions (“T&C”) carefully before using our website or booking our services. By accessing or using the site (vivantastays.com) and/or making a reservation, you agree to be bound by these T&C.

1. Definitions

  • “Vivanta Stays,” “we,” “us,” or “our”: Vivanta Stays
  • “Guest,” “you,” or “your”: Any person who browses the website, makes a booking, or uses our services.
  • “Booking”: A confirmed reservation for a villa stay, including any ancillary services.
  • “Property”: Any villa or accommodation listed on our website.

2. Booking & Payment Terms

1.Advance & Balance
  • 50% of the total booking amount is due as advance at the time of confirmation.
  • 50% balance is due at check-in.

2. Modes of Payment

  • We accept NEFT, RTGS, IMPS or UPI transfers to our Current Account.
  • All amounts are in Indian Rupees (Rs).

3. Taxes & Fees

  • Quoted rates are inclusive of all applicable taxes and service charges, unless stated otherwise.

3. Cancellation & Refund Policy

1. Guest-Initiated Cancellation

  • If you cancel more than 30 days prior to check-in: Full refund minus a 20% cancellation fee on the advance.
  • If you cancel 15–30 days prior: 50% refund of the advance.
  • If you cancel within 15 days or fail to show up: No refund of the advance.

2. Vivanta Stays-Initiated Cancellation

  • We reserve the right to cancel or alter your booking due to unforeseen circumstances (e.g., force majeure, property issues).
  • In such cases, we will either arrange an equivalent alternative property or provide a full refund of all amounts paid.

3. Refund Timeline

  • Refunds will be processed within 7–10 business days of cancellation confirmation.

4. Check-In & Check-Out

  • Check-In: From 1:00 PM onwards on the arrival date.
  • Check-Out: By 11:00 AM on the departure date.
  • Early check-ins or late check-outs may incur additional charges and are subject to availability.

5. Guest Responsibilities

  • Guests must provide accurate personal details at booking.
  • Any damage to the property or its contents during the stay will be charged as per repair/replacement costs.
  • Smoking is prohibited indoors unless expressly permitted.
  • Pets are allowed only at designated properties and with prior written consent. Additional pet charges may apply.

6. Intellectual Property

  • All content on vivantastays.com (text, images, logos, videos) is owned or licensed by Vivanta Stays and protected under applicable copyright and trademark laws.
  • You may not reproduce, distribute, or create derivative works without our express written permission.

7. Limitation of Liability

  • To the fullest extent permitted by law, Vivanta Stays shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your booking or stay.
  • Our total liability will not exceed the amount you have paid for the booking.

8. Indemnification

  • You agree to indemnify and hold harmless Vivanta Stays and its affiliates, officers, agents, and employees from any claims, liabilities, losses, and expenses (including legal fees) arising out of your violation of these T&C or your negligence.

9. Privacy & Data Protection

  • Our Privacy Policy governs how we collect, use, and protect your personal information. By using our services, you consent to the terms of that policy.

10. Governing Law & Dispute Resolution

  • These T&C are governed by the laws of India.
  • Any dispute arising hereunder shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

11. Amendments

  • We may revise these T&C from time to time without prior notice. The “Last updated” date at the top will reflect the effective date. Continued use of the website or services signifies your acceptance of any changes.
